Workers Compensation Law

One may say that nowadays the workers’ rights are better protected than in any other time in the history. If some decades ago getting work was as easy as losing it nowadays employees are protected against potential violations on the part of their employers by the workers compensation law. This law entails a great array of rights and has strengthen the position of the employee with regards to his employer. The aim of the workers compensation law has been to protect the workers from being abused by their employees. This means that people nowadays are more difficult to be fire in certain circumstances and that employers may not legally get rid of employers they no longer desire from reasons that are not related to the financial situation of the company or to personal reasons, for instance. Although there are differences with this law from a state to another, the law covers the prohibition of employers to terminate or refusing to hire an individual in cases which that individual has reported an injured at the workplace or has filed a workers’ compensation claim. Thus here one may notice the link between this law and the injured workers. In this instance if an employee would want to fire an injured worker, this would not be possible as long as the employee can prove that the injury took place at work. However, the protection against being made redundant as a result of filling a claim is more difficult to enforce as it is often difficult to prove the reason of having the work contract terminated in such cases.
